Murder Conviction Upheld in Death of Atlanta Store Owner
Atlanta -- The Georgia Supreme Court has upheld the murder conviction against a DeKalb County man for the murder of well-known liquor store owner Shamsher “Rocky” Tucker during an attempted robbery.
The Georgia Supreme Court rejected Battles’ entire plea, writing in its opinion, “The evidence was sufficient to enable any rational trier of fact to find (the) appellant guilty beyond a reasonable doubt, of the crimes for which he was convicted.”
Rodney Ennis Battles, whose first trial ended in a hung jury, was convicted during a second trial in 2007. Two men armed with handguns approached Tucker and his wife Ruby in their driveway after they returned home from the liquor store on Briarcliff Road around midnight. When Tucker stepped out of his truck to enter his home, one of the men pointed his gun at Tucker and the other held Ruby at gunpoint.
Tucker pulled out a handgun and fired at the suspects, who returned fire. Tucker was shot several times.
The two suspects sped off in a pickup truck, leaving cash profits from the liquor store untouched in Tucker's car. Police said Tucker brought the money home because it was too late to deposit it in a bank.
Battles was captured after he went to a doctor with a gunshot wound to his leg a few days after the murder.
